On August 13, 2025, the Customs, Excise, and Service Tax Appellate Tribunal (CESTAT), Hyderabad, delivered a significant judgment in a series of appeals concerning the confiscation of smuggled gold, sale proceeds, and penalties imposed under the Customs Act, 1962. The case involved multiple appellants and revolved around the seizure of 40 gold bars with foreign markings and substantial cash, allegedly linked to smuggling activities. Background of the Case
The case originated from a seizure conducted by the Directorate of Revenue Intelligence (DRI) on November 21, 2019, at a residence in Secunderabad. The officers discovered 40 gold bars weighing 100 grams each, marked “AL ETIHAD DUBAI โ UAE 100G 999.0,” along with cash totaling Rs. โ 1,99,97,700. The gold and cash were concealed in a specially designed compartment of a vehicle. โ Statements from the appellants revealed a complex network of transactions involving smuggled gold transported from Calicut to Hyderabad.
